1.Who we are

Wosia (“the Platform”) is an online estate-planning service owned and operated by IVIO Advocates LLP, a limited liability partnership of advocates registered in the Republic of Kenya (“IVIO”, “we”, “us”).

2.What the Platform does

The Platform provides guided document preparation. It collects your instructions through a structured interview and assembles a draft will from clause templates settled and approved by advocates, together with signing instructions, a schedule of assets, and related materials. Where you purchase advocate review, a practising advocate reviews your specific draft and provides written comments.

3.Not legal advice; no retainer by mere use

Use of the Platform's automated features — the interview, drafting checks, document generation, and general guidance — does not constitute legal advice on your individual circumstances and does not create an advocate–client relationship or retainer between you and IVIO. The automated guidance is general information about Kenyan succession law.

This is so even though the Platform is operated by a firm of advocates: the automated service is document preparation, not advice, and you should not treat it as a substitute for consulting an advocate about your particular situation.

4.Advocate review

If you purchase advocate review, a practising advocate holding a current practising certificate will review the specific version of your draft that you submit and provide written comments and, where appropriate, approval of that version. Reviewing advocates are advocates of IVIO Advocates LLP or of affiliated law firms instructed by IVIO for that purpose.

Advocate review is a limited-scope engagement: it covers the reviewed version of your will only, and does not extend to your wider affairs, tax planning, ongoing advice, or any later version of your will unless separately engaged. Before an advocate accepts your review, the firm will run its usual conflict checks.

Prices are displayed in Kenya Shillings and are payable before documents can be downloaded. We accept M-Pesa and card payments through licensed payment providers. Completing the interview and viewing drafting checks is free.

7.Your responsibilities after download

A will has legal effect only when executed in accordance with the Law of Succession Act (Cap. 160): signed by you in the presence of two or more competent witnesses present at the same time, who each attest the will.

The witness rule that catches most people. A gift to an attesting witness, or to a witness's spouse, is void under section 13 of the Act. Choose witnesses who receive nothing under your will.

You are responsible for executing, storing and, where appropriate, updating your will. We provide instructions; we cannot and do not supervise execution.

Uploading a copy of your signed will. The Platform may let you upload a copy of your executed will to keep alongside your Wosia documents. Any copy you upload is a convenience copy only. Uploading a copy does not create, validate or replace your will: we do not check that the document is a validly executed will under the Law of Succession Act (Cap. 160), that it was correctly witnessed, or that it is current, and accepting an upload is not confirmation of any of these. Your signed paper original remains the operative document, and you must keep it safe. We store uploaded copies with encryption and take reasonable measures to protect them, but we do not presently offer custodial safekeeping of original wills for executors, and we are not responsible for ensuring that an uploaded copy can be located or relied upon after your death. You may remove an uploaded copy at any time.

8.Intellectual property and licence

The Platform, its clause library, software, designs and content are the property of IVIO or its licensors. On payment, we grant you a perpetual licence to use, reproduce and execute the documents generated for you, for your personal estate-planning purposes. You may not resell, publish or systematically extract the clause library, or use the Platform to provide services to third parties, without our written agreement.

We aim for continuous availability but do not guarantee it. We may update the Platform, clause templates and drafting checks to reflect changes in law or practice. Documents you have already generated are preserved with the exact wording used at the time; updates to the clause library do not alter documents you have already downloaded.

11.Limitation of liability

Nothing in these Terms excludes or limits liability that cannot be excluded under Kenyan law, including liability for fraud. Subject to that:

12.Suspension and termination

We may suspend or close accounts used in breach of these Terms. You may close your account at any time from your dashboard; on closure you may first export your documents and data, and deletion is handled as described in the Privacy Policy.

13.Governing law and complaints

These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute. This does not affect your right to complain to the Office of the Data Protection Commissioner about data-protection matters, or to the Law Society of Kenya or the Advocates Complaints Commission about professional-conduct matters concerning advocate review.

14.Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-Platform notice at least fourteen (14) days before taking effect, and will not apply retrospectively to documents already purchased.
