1.Document preparation, not legal advice

Wosia's automated features prepare documents from your instructions using clause templates settled by advocates. General explanations on the Platform describe Kenyan succession law but are not advice on your individual circumstances, and using the Platform does not, of itself, create an advocate–client relationship with IVIO Advocates LLP. Individualised professional attention is provided only where you purchase advocate review, and then only to the extent described in the Terms of Use.

2.Your will is valid only when properly executed

No online service can make your will effective. Under the Law of Succession Act (Cap. 160), a written will must be signed by you (or by someone at your direction, in your presence) and attested by two or more competent witnesses present at the same time.

A gift to an attesting witness, or to a witness's spouse, is void (section 13). Follow the signing instructions supplied with your documents exactly; if in doubt, execute before an advocate.

3.No guarantee of legal outcome

We take care to reflect Kenyan law in our clause library and checks, but no drafting service can guarantee how a court will treat a will. In particular, a spouse, child or dependant left without reasonable provision may apply to court under section 26 of the Law of Succession Act, and courts have wide powers on such applications. Careful, deliberate provision — which our checks encourage — reduces but cannot eliminate this risk.

4.Some estates need more than software

If your circumstances include significant business interests, property outside Kenya, a polygamous or blended family with likely disagreement, a beneficiary with special needs, contested prior wills, or the application of Islamic law to your estate, we recommend advocate review as a minimum and, in complex cases, a full consultation with an advocate. The Platform's checks flag many of these situations and will tell you when we think software alone is not enough.

5.Not tax or financial advice

The Platform does not provide tax, investment or pension advice. Matters such as pension and provident-fund nominations, life-insurance nominations and jointly held property may pass outside your will and are affected by rules beyond it; verify nominations directly with the relevant institutions.

6.Your information drives the result

Your documents are only as good as the answers you give. We cannot verify ownership of assets, family relationships or identity details, and we accept no responsibility for the consequences of inaccurate, incomplete or outdated answers, or of failing to update your will after marriage, divorce, births, deaths, or significant changes in your property.

7.Urgent situations

If a will is needed urgently — for example, serious illness — do not rely on completing an online process in time. Contact an advocate immediately; wills can be validly made at short notice with proper professional assistance.

8.Third-party services

Payments are processed by third parties (including Safaricom's M-Pesa and card networks) under their own terms. We are not responsible for the availability of third-party services or for content on external sites we may link to.
